MacraPay Terms of Use

1. Acceptance of Terms

By registering for an account, accessing, or using the Services, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. These Terms form a legally binding agreement between you ("User," "you," or "your") and Macra Systems ("MacraPay," "we," "us," or "our").

2. Description of Services

MacraPay provides payment processing solutions, including:

• Mobile Money Payments: Accepting payments via platforms like M-Pesa with instant settlement.
• Card Payments: Processing international Visa, Mastercard, and American Express payments.
• Instant Withdrawals: Transferring funds to mobile wallets or bank accounts in under 10 seconds.
• Analytics Dashboard: Offering real-time transaction and revenue tracking.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time.

3. Eligibility and Account Registration

To use the Services, you must:

• Be a legally recognized individual, business, or entity.
• Provide accurate and complete information during registration.
• Maintain the security of your account credentials.

MacraPay may refuse service or terminate accounts for suspected fraud or violation of these Terms.

4. User Responsibilities

You agree to:

• Comply with all applicable laws, including payment processing and anti-money laundering regulations.
• Provide accurate transaction information.
• Not use the Services for illegal activities, such as fraud or money laundering.
• Pay all applicable fees as outlined in our fee schedule.
• Notify us of disputes or errors within 30 days.

5. Fees and Payments

• Transaction Fees: Mobile money transactions start at 1%, international card payments at 2%. No hidden fees apply.
• Changes to Fees: Fees may change with 14 days’ notice via email or the Services.
• Refunds: Subject to our Refund Policy on our website.

6. Security and Data Protection

MacraPay is PCI-DSS Level 1 compliant and uses 256-bit SSL encryption. You agree to:

• Safeguard your account information.
• Comply with data protection laws.
• Report security issues to support@macrapay.com.

7. Intellectual Property

All content, trademarks, and software are owned by Macra Systems or its licensors. You may not copy or reverse-engineer the Services.

8. Prohibited Activities

You agree not to:

• Process payments for illegal goods or services.
• Interfere with our security measures.
• Use automated systems to extract data.
• Disrupt the Services.

9. Termination

We may suspend or terminate your access for violations, fraud, or inactivity. Outstanding fees remain payable.

10. Limitation of Liability

MacraPay is not liable for indirect damages or losses caused by third parties. Our liability is limited to fees paid in the prior 6 months.

11. Indemnification

You agree to indemnify MacraPay against claims arising from your use of the Services or violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by Kenyan law. Disputes will be resolved through arbitration in Nairobi under the Chartered Institute of Arbitrators (Kenya Branch).

13. Modifications to Terms

Changes will be posted on our website. Continued use constitutes acceptance.

14. Compliance with Regulations

MacraPay is licensed by the Central Bank of Kenya. You must comply with all relevant laws.
